Suvendu Adhikari has accused the Chief Minister of making false statements—both inside and outside the Legislative Assembly—regarding the anti-goonda law. The Chief Minister has been stoking tensions by suggesting that action under this law would be taken against anyone who speaks out or protests against the government. However, the State Advocate General admitted before the Calcutta High Court that, although the bill was passed in the State Assembly, it has not yet received the President’s assent.
A petition regarding the ‘Goonda Suppression Act’ was filed in the Calcutta High Court on behalf of AILU. The petitioners pointed out that the Chief Minister was proposing to take action under a law that had not yet received the President’s assent. Advocate Shamim Ahmed, representing the petitioners, stated, “We wanted to determine what was correct—the Chief Minister’s claims or the actual reality. Today, it has become clear in court that the Chief Minister is making false statements. How can she propose taking action under a law that has not yet received any official recognition?”
Shamim Ahmed further stated, “On this day, both the State Advocate General and the Deputy Advocate General acknowledged in the High Court that the Act has not yet received the President’s assent. Consequently, the case was dismissed. However, after this was conveyed to the court, the court observed that a fresh case regarding the Act could be filed once it receives official approval.”
It is worth noting that the Chief Minister has repeatedly spoken about invoking this anti-goon law—specifically regarding the rape and murder of a minor in Baruipur and the CJP agitation at Dharmatala. She has even advocated for the enforcement of this law while addressing the Legislative Assembly. In other words, the Chief Minister—who took an oath in the name of the Constitution—has misled the people of the state by making false statements on the floor of the Assembly.
