The Communist Party of India (Marxist) has expressed deep concern and strong protest over the massive exclusion of names from the voter list in West Bengal after the SIR in the state. In a letter to the Election Commission, party general secretary MA Baby said that about 12 percent of the total voters in the state, i.e. more than 90 lakh people, have been excluded from the list during the SIR process. He attacked the Election Commission's move as a well-planned scheme to deprive the masses of their right to vote.
In the letter, the CPI(M) general secretary wrote that many voters' names were left in an opaque category called 'under adjudication'. The promised mechanisms for name correction did not work at all or were beyond the reach of the common man.
The CPI(M) claims that this was not a simple administrative update of the voter list. Instead of transparent and field-based verification, names were automatically excluded based on arbitrary criteria and algorithms like 'logical consistency'. This process, which breaks with previous rules, has seen voters as suspects and has placed the onus of proving their citizenship on them. It has been alleged that this process has caused huge financial losses, harassment, psychological trauma and even deaths to the common man.
Baby also questioned the opacity of the entire process. Allegedly, the lists were published in a format that was not analyzable, as a result of which the common man or analysts did not get a chance to examine them. In various cases, it has been seen that the marginalized groups have been the most affected by this process. Especially minority Muslims, women and the economically backward sections.
The CPI(M) has clearly stated that such exclusion of names from the electoral rolls is in direct violation of Article 326 of the Constitution of India. The right to vote is a fundamental democratic right, which is inextricably linked to the equality and dignity of citizens. Depriving people, especially the marginalized classes, of this right is a major blow to the basic principles of the Constitution. Strongly condemning this discriminatory and mass disenfranchisement process of the Election Commission, the CPI(M) said in its statement that the Election Commission of India must ensure the constitutional right to vote of the citizens of the country at any cost. In a democratic country, no one can be deprived of his rights in this way.

বাংলায় প্রথম দফার ভোটের আগে লক্ষ লক্ষ ভোটারের নাম তালিকা থেকে বাদ পড়ার আশঙ্কা তৈরি হয়েছে। ট্রাইব্যুনাল কাজই শুরু করেনি। যাচাই প্রক্রিয়া অসম্পূর্ণ থাকায় তাঁদের ভোটাধিকার অনিশ্চিত। বহু কিংবা হাজার হাজার যোগ্য ভোটার যদি শুধু যাচাই শেষ না হওয়ার কারণে ভোটাধিকার থেকে বঞ্চিত হন, তাহলে তা হবে নির্বাচনী প্রক্রিয়ার ত্রুটি। ফলে ভোটটাই তো ‘অন্যায্য’ হয়ে যাবে। কুরেশির সোজাসাপ্টা মন্তব্য, এমন পরিস্থিতি ‘অত্যন্ত নিন্দনীয়’। তিনি প্রশ্ন তোলেন, কমিশন কি শপথনামা দিয়ে বলতে পারবে, “একজনও যোগ্য ভোটার বাদ পড়েননি”?
প্রশ্ন ছিল, প্রশাসনিক অদক্ষতায় যদি সময় ফুরিয়ে যায় এবং যাচাই প্রক্রিয়া শেষ না হওয়ায় বহু যোগ্য ভোটার তালিকা থেকে বাদ পড়েন তাহলে কি তা অসাংবিধানিক? প্রাক্তন মুখ্য নির্বাচন কমিশনার কুরেশির স্পষ্ট জবাব, “হ্যাঁ, অবশ্যই। তাতে নির্বাচনই প্রশ্নবিদ্ধ হবে।”
কুরেশি বলেন, সংবিধানের ৩২৬ অনুচ্ছেদ ভোটাধিকারকে নিশ্চিত করেছে। প্রশাসনিক দেরি বা ব্যর্থতার কারণে এই অধিকার কোনোভাবেই কেড়ে নেওয়া যায় না। যাচাই করা রাষ্ট্রের দায়িত্ব, কিন্তু সময়মতো তা শেষ না হলে ভোটারকে কিছুতেই শাস্তি দেওয়া যাবে না। তিনি বলেছেন, ‘যাচাই’ করা যায়। কিন্তু “অধিকার থেকে বঞ্চিত” করা যায় না। অর্থাৎ, আবেদন বিচারাধীন থাকলে সেই ভোটারকে অযোগ্য বলা যাবে না।
প্রাক্তন মুখ্য নির্বাচন কমিশনার এই সমস্যা সমাধানের নির্দিষ্ট প্রস্তাবও দিয়েছেন। তাঁর মতে, যাদের নাম বিবেচনাধীন রয়েছে, তাদের জানুয়ারি ২০২৫-এর যে ভোটার তালিকা অনুযায়ী ভোট দেওয়ার অনুমতি দেওয়া হোক, চূড়ান্ত সিদ্ধান্ত পরে নেওয়া হবে।
তিনি সতর্ক করে বলেছেন, “একজন ভোটারও যদি অন্যায়ভাবে বাদ পড়েন, সেটা নীতিগত প্রশ্ন।” তাঁর মতে, ভোট একবার হারালে তা ফেরানো যায় না—ক্ষতি চূড়ান্ত। এই পরিস্থিতি গণতন্ত্রে “কালো দাগ” হয়ে থাকবে বলেও তিনি মন্তব্য করেছেন।
কুরেশি বলেছেন, সংখ্যা নয়, নীতিই আসল। ১০ জন হোক বা ১০ লক্ষ, যোগ্য ভোটার বাদ পড়া মানে নির্বাচনই কলঙ্কিত। প্রশাসনের ভুলে ভোটার শাস্তি পেলে, গণতন্ত্রের ভিত্তিই কেঁপে যায়।
